Terms of service

This agreement is between HSH Design (‘we’, ‘us’), a design and print-production studio operating from Pakistan, and the business that opens an account or commissions work (‘you’).

It covers three things: the proofing platform at https://hshdesign.com/proof/, studio work we do for you, and this website. Where a signed order or written quote says something different from this page, the order or quote wins for that engagement.

It applies to businesses. The platform is not sold to consumers and is not intended for anyone under 18.

Access to the platform for the plan you are on, and the studio work you commission. We will provide both with reasonable skill and care.

We will keep the platform available as far as we reasonably can, and we will tell you in advance about planned maintenance where we can plan it. We do not offer a contractual uptime percentage, and we would rather say so here than publish a number we cannot stand behind. If availability guarantees are a hard requirement for you, tell us before you sign up rather than after.

We may change how features work as the platform develops. If a change removes something you rely on, we will give you at least 30 days’ notice and you may end the agreement over it under clause 11.

You are responsible for who you give a login to and for what they do with it. Give each person their own — shared logins make the activity log useless as evidence, which matters on the day an approval is disputed.

Turn on two-factor authentication and leave it on. Tell us promptly at hello@hshdesign.com if you think an account has been compromised, and we will help you shut it down.

We will never ask you for your password. Anyone who does is not us.

The short version is: do not use the platform to break the law or to break the platform.

• Do not upload artwork you have no right to reproduce, or content that is unlawful in the place it will be produced or viewed.
• Do not use it to send bulk unsolicited email, or to distribute malware.
• Do not attempt to reach another tenant’s data, probe for vulnerabilities without telling us, or work around the platform’s access controls. Reporting a flaw you found is welcome and will never be treated as a breach of this clause.
• Do not resell platform access as your own product without a written agreement — white-labelling for your own customers is expected and fine; reselling seats is not.
• Do not automate against the platform in a way that degrades it for other shops.

If something here is being broken and it is causing harm, we may suspend the account to stop the harm and will tell you why, the same day, with what has to change to lift it. We will not use suspension as a debt-collection tool.

For everything you put into the platform, you are the controller and we are the processor. We process it on your documented instructions and for no other purpose. The full terms are in the data processing addendum, which forms part of this agreement, and the plain-English version is on Your data.

We will not use your content to train machine-learning models, sell it, or mine it for our own commercial purposes. This is a term of the contract, not a policy we can change unilaterally.

How we handle personal data where we are the controller — your enquiry, our billing records, this website — is set out in the privacy policy.

Plans run from $0 to $39 / month, exactly as published on the pricing page. USD, billed monthly by invoice. No card details are held.

Invoices are due within 14 days unless your order says otherwise. We do not store card details, because we do not take card payments — there is nothing on file to be leaked.

If an invoice goes unpaid we will chase it like a business, not like a hostage-taker: we will contact you, and we will not delete your data or lock you out of an export because of a billing dispute. Persistent non-payment can end the agreement under clause 11, and your export rights survive that.

Studio work is quoted per job. A quote is valid for 30 days and we will not change the price mid-job unless you change the brief.

We may change plan prices with at least 30 days’ notice. A price rise never applies to an invoice already issued.

If you connect a social account, that platform’s own terms govern what it does, and its API can change or break without notice. We will keep the connection working where we reasonably can, and we are not responsible for what a third-party service does at its end.

Printing, courier and finishing partners engaged for your job are covered by the quote for that job.

We are liable for the things a supplier should be liable for: failing to provide the service with reasonable skill and care, breaching the data protection terms, breaching confidentiality, and anything the law does not allow us to limit — which includes death or personal injury caused by our negligence, and our own fraud.

Except for those, our total liability in any twelve-month period is limited to the amount you paid us in that period. We are not liable for loss of profit, loss of business or indirect loss.

A print job carries its own risks and its own division of responsibility: you approve the proof. Once a proof is approved through the platform, the approval is the record of what was authorised, and we are not liable for a production run that matches the approved proof. If we produce something that does not match it, that is ours to put right.

Nothing here limits a right you have under a law that does not allow it to be limited.

Each side will keep the other’s non-public information confidential and use it only for this agreement. That covers your customer lists, your pricing and your unreleased artwork as much as it covers our software.

It does not cover information that is already public, that the receiving side already had, or that the law compels disclosure of — and where the law compels it, clause 8 of the privacy policy says what we will do about it.

This clause outlives the agreement.

You can close your account at any time, for any reason or none. There is no minimum term on the monthly plans and no exit fee.

We can end the agreement with 30 days’ notice, or immediately if clause 4 is being seriously broken or an invoice has gone long unpaid after we have chased it.

Whoever ends it and however it ends, you get your data:

• An export of your jobs, proofs, customer records and approval history, in a loadable format, on request.
• At least 30 days from the end date to ask for that export.
• Deletion from live systems within 30 days of your request or the end of that window, and from rolling backups as they expire within 90 days.

Invoices already issued remain payable. Clauses on ownership, confidentiality, liability and data protection survive.

We will email account holders at least 30 days before a change that reduces what you get or increases what you owe. Carry on using the platform after it takes effect and you have accepted it; close the account before then and the old terms govern everything up to that point.

Corrections and clarifications that do not change the substance take effect when published. The date at the top of this page moves when the substance changes.

This agreement is governed by the laws of the Islamic Republic of Pakistan, and the courts of Islamabad, Pakistan have jurisdiction.

One governing law, stated openly, rather than terms that vary with where a visitor appears to be connecting from. A contract that changes with the reader is one neither side can prove the contents of later, and IP-based geolocation is wrong often enough — a VPN, a roaming SIM, a mobile carrier routing through another country — that it would misfire on real customers at exactly the wrong moment. Your own consumer-law rights, where you have them, are not taken away by this clause.

Before anyone involves a court: write to hello@hshdesign.com and give us 30 days to sort it out. Most things that look like a dispute are a misunderstanding about a proof, and those get fixed in an afternoon.

If a clause here turns out to be unenforceable, the rest stands.
